1. Acceptance of Terms

Welcome to Frynd AI (the "App"). These Terms and Conditions ("Terms") govern your access to and use of the Frynd AI mobile application, operated by Frynd AI ("we," "us," or "our"). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms in full.

If you do not agree to these Terms, please do not download, install, or use the App. Your continued use of the App after any updates to these Terms constitutes your acceptance of the revised Terms.

These Terms apply to all users of the App, including users accessing the App through Apple TestFlight during the beta testing phase.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use Frynd AI. By using the App, you represent and warrant that you meet this age requirement. If you are between the ages of 13 and 18, you represent that you have obtained the consent of a parent or legal guardian to use the App.

2.2 Intended Audience

Frynd AI is designed and intended primarily for women. By using the App, you acknowledge that the content, tone, and companion experience are tailored with this audience in mind.

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at youraifrynd@gmail.com if you become aware of any unauthorized use of your account.

3. Description of the App

Frynd AI is a conversational AI companion application designed to provide emotional support, meaningful conversation, and personal growth insights to its users. The App offers the following core features:

• Real-time AI chat — conversational sessions with your AI companion, powered by Anthropic's API
• Chat history — the ability to view and revisit past conversation sessions
• Chat summaries — AI-generated summaries of your conversation sessions
• Mindset scores — personalized scores across five pillars (Emotional State, Confidence, Growth Orientation, Resilience, and Self-Compassion), derived from your conversations
• Session management — the ability to delete individual chat sessions or your entire account and associated data

4. AI Companion — Important Disclaimers

4.1 Not a Mental Health Service

Frynd AI is an AI-powered companion application and is NOT a mental health service, therapy platform, or medical service of any kind. The App is not a substitute for professional mental health care, counseling, psychotherapy, psychiatric services, crisis intervention, or any other form of licensed professional support.

If you are experiencing a mental health crisis, thoughts of self-harm or suicide, or any other urgent situation, please contact a qualified mental health professional or emergency services immediately. In the United States, you can reach the 988 Suicide and Crisis Lifeline by calling or texting 988.

4.2 Nature of AI Responses

The responses generated by your AI companion are produced by artificial intelligence and do not represent the opinions, advice, or recommendations of licensed professionals. AI responses may be inaccurate, incomplete, or unsuitable for your specific circumstances. You should not rely on the App as your sole source of support or guidance for important life decisions.

4.3 Mindset Scores Are Not Clinical Assessments

The mindset scores generated across the five pillars (Emotional State, Confidence, Growth Orientation, Resilience, and Self-Compassion) are AI-derived indicators intended for personal reflection and self-awareness only. They are not clinical assessments, diagnostic tools, or validated psychological measures. They should not be interpreted as medical or psychological diagnoses.

4.4 No Guaranteed Availability

We do not guarantee that the App or the AI companion will be available at all times. The App may be subject to interruptions due to maintenance, updates, technical issues, or circumstances beyond our control.

5. User Accounts

5.1 Account Creation

To use the App, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

5.2 One Account Per User

Each user may maintain only one active account. Creating multiple accounts is not permitted.

5.3 Account Security

You are solely responsible for all activity that occurs under your account. You agree not to share your login credentials with any third party. We are not liable for any loss or damage arising from unauthorized use of your account.

5.4 Account Termination by Us

We reserve the right to suspend or permanently terminate your account at our sole discretion, without notice, if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or posed a risk to other users or the integrity of the App.

6. Acceptable Use

6.1 Permitted Use

You may use Frynd AI solely for your personal, non-commercial use in accordance with these Terms and all applicable laws and regulations.

6.2 Prohibited Conduct

You agree that you will not use the App to:

• Violate any applicable local, national, or international law or regulation
• Harass, abuse, threaten, or harm any person
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Use automated tools, bots, or scripts to access or interact with the App
• Attempt to gain unauthorized access to any part of the App, its servers, or its databases
• Transmit any malicious code, viruses, or harmful software
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the App for any commercial purpose without our prior written consent
• Attempt to extract, scrape, or collect data from the App in any unauthorized manner
• Engage in any activity that could damage, disable, or impair the App or interfere with other users' access

7. User Content and Data

7.1 Your Content

You retain ownership of the messages, content, and information you submit through the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the App's services, subject to your consent preferences as described in our Privacy Policy.

7.2 Content Standards

You are solely responsible for the content of your conversations within the App. You agree not to submit User Content that:

• Is unlawful, harmful, threatening, abusive, defamatory, or obscene
• Infringes the intellectual property rights of any third party
• Contains personal information about third parties shared without their consent
• Is intended to manipulate, deceive, or exploit the AI system

7.3 AI Training Consent

We will only use your conversation data for AI model training if you have explicitly opted in and provided your affirmative consent within the App. You may withdraw this consent at any time through the App settings. Please refer to our Privacy Policy for full details.

7.4 Data Deletion

You may permanently delete individual chat sessions or your entire account at any time within the App. These actions are irreversible. Please refer to our Privacy Policy for full details on data deletion.

8. Intellectual Property

8.1 Our Intellectual Property

The App, including its design, features, content, branding, logos, and underlying technology, is owned by Frynd AI and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license to use it as described herein.

8.2 Restrictions

You may not copy, modify, distribute, sell, sublicense, or create derivative works based on the App or any part of it without our prior written permission.

8.3 Feedback

If you submit feedback, suggestions, or ideas about the App (including during the beta testing phase), you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback into the App without any obligation to you.

9. Third-Party Services

The App integrates with the following third-party services to deliver its functionality:

• Google Firebase Authentication — for secure user login and identity management
• Google Firestore — for secure cloud storage of your account data, chats, summaries, and mindset scores
• Anthropic API — for powering real-time AI responses, generating chat summaries, and producing mindset scores

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party services. 10. Beta Testing

The App is currently distributed as a beta version through Apple TestFlight. By participating in the beta program, you acknowledge and agree that:

• The App is still under development and may contain bugs, errors, or incomplete features
• Your experience may not reflect the final version of the App
• We may make significant changes to features, design, or functionality before public launch
• Feedback you provide during the beta phase is valuable and may be used to improve the App
• We may terminate the beta program or your beta access at any time without notice

All provisions of these Terms apply equally during the beta testing phase.

11. Disclaimers and Limitation of Liability

11.1 App Provided As-Is

Frynd AI is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

11.2 Limitation of Liability

To the fullest extent permitted by applicable law, Frynd AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, emotional distress, or any other damages arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

11.3 Maximum Liability

Our total liability to you for any claims arising out of or related to these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Frynd AI and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

13. Privacy

Your privacy is important to us. Our collection, use, and handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to our Privacy Policy. We encourage you to read it carefully.

14. Modifications to the App and Terms

14.1 Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14.2 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by displaying a prominent notice within the App or by sending an email to the address associated with your account. The updated Terms will take effect as of the date specified in the notice. Your continued use of the App after that date constitutes your acceptance of the updated Terms.

15. Termination

You may stop using the App at any time and delete your account through the App settings. Upon account deletion, your data will be permanently erased from our systems as described in our Privacy Policy.

We may terminate or suspend your access to the App at any time, with or without cause or notice, at our sole discretion. Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8 (Intellectual Property), 11 (Disclaimers and Limitation of Liability), and 12 (Indemnification).

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. If you are located outside the United States, you may also be subject to the laws of your local jurisdiction.

16.2 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at youraifrynd@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your written notice.

16.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

17. Apple TestFlight and App Store Terms

The App is currently distributed via Apple TestFlight. Your use of the App through TestFlight is also subject to Apple's TestFlight Terms and Conditions. Once the App is publicly available, your download and use of the App through the Apple App Store will also be subject to Apple's App Store Terms of Service.

Frynd AI, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support for the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce them against you.

18. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it will be severed from these Terms. The remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Frynd AI with respect to your use of the App, and supersede all prior agreements, understandings, or representations relating to the same subject matter.
